Agreement

These Terms and Conditions govern access to and use of Estetix websites, patient discovery experiences, clinic-specific AI assistants, embedded widgets, dashboards, checkout flows, and related services provided by Estetix, Inc.

By accessing or using Estetix, submitting a clinic application, creating an account, using an AI assistant, or purchasing a subscription, you agree to these Terms. If you use Estetix on behalf of a clinic or organization, you represent that you have authority to bind that organization.

Services

Estetix provides AI-powered aesthetic medicine discovery, clinic matching, consultation support, lead capture, WhatsApp or CRM routing, website widgets, dedicated clinic chatbot links, booking workflows, dashboards, analytics, and related infrastructure.

Service availability and features depend on plan, geography, clinic configuration, operational readiness, approved integrations, and technical constraints. Some features may be beta, invite-only, or pending deployment.

Eligibility And Clinic Access

• Clinic memberships are application-based and may be approved, rejected, waitlisted, limited by city or treatment category, suspended, or terminated at Estetix discretion.
• Clinic users must provide accurate information and keep clinic profile, public action URLs, billing details, and authorized staff access current.
• Clinic dashboard access is separate from registry inclusion. Estetix may list or manage clinic metadata independently from a clinic staff account until access is granted.
• You are responsible for all activity under your account and for maintaining the confidentiality of credentials and authorized integrations.

Acceptable Use

• Do not use Estetix for unlawful, unsafe, deceptive, abusive, infringing, or unauthorized purposes.
• Do not attempt to bypass rate limits, security controls, tenant isolation, access controls, payment controls, or clinic verification processes.
• Do not upload content that you do not have the right to provide, including photos or personal information submitted without appropriate consent or authority.
• Do not use Estetix to request or provide emergency care, medical diagnosis, prescription decisions, direct treatment execution, or other regulated clinical decisions outside an appropriate provider relationship.
• Do not scrape, reverse engineer, copy, resell, frame, or misuse the platform except as expressly permitted in writing.

Medical And Clinical Boundaries

Estetix is a decision-support and communication platform. It is not a medical device, healthcare provider, emergency service, electronic medical record replacement, or substitute for a licensed clinical professional.

AI outputs, photo analysis, clinic recommendations, treatment explanations, and booking suggestions are informational and non-diagnostic. Final clinical decisions remain with qualified practitioners and the patient.

Clinic Responsibilities

• Clinics are responsible for professional services, clinical judgment, patient communications, consent, pricing accuracy, appointment availability, legal disclosures, advertising compliance, and treatment outcomes.
• Clinics must ensure that treatment menus, pricing, practitioner biographies, policies, before-and-after images, and other clinic materials supplied to Estetix are accurate, lawful, and authorized.
• Clinics are responsible for reviewing routed leads and responding to patients through configured WhatsApp, CRM, booking, or staff workflows.
• Clinics must comply with all laws and professional rules applicable to their jurisdiction, including privacy, advertising, consumer protection, and medical practice requirements.

Subscriptions, Fees, And Billing

Paid plans are billed according to the applicable order, checkout, invoice, or subscription terms. Estetix may use Stripe or another payment provider to process payments. Prices may vary by market and currency.

Unless otherwise stated in a written agreement, subscriptions renew until canceled. Fees are non-refundable except where required by law or expressly stated by Estetix. Estetix may change pricing or plan features with reasonable notice where required.

Third-Party Services

The platform may integrate with third-party services for hosting, databases, analytics, AI models, knowledge retrieval, payments, WhatsApp, CRM, calendars, email, and booking systems. Estetix is not responsible for third-party services outside its control, and use of those services may be subject to separate terms.

Intellectual Property

Estetix and its licensors own the platform, software, design system, workflows, code, models, documentation, trademarks, and related intellectual property. These Terms do not transfer ownership of Estetix intellectual property.

Clinics and users retain ownership of content they submit, subject to the rights granted to Estetix to host, process, display, route, analyze, and otherwise use that content to provide, secure, support, and improve the services.

Availability And Changes

Estetix may modify, suspend, limit, replace, or discontinue features, plans, domains, integrations, or services as needed for security, compliance, operations, product development, or business reasons. We work to maintain reliable service but do not guarantee uninterrupted or error-free availability.

Disclaimers

The services are provided on an as-is and as-available basis to the maximum extent permitted by law. Estetix disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and any implied warranties arising from course of dealing or usage of trade.

Estetix does not guarantee patient volume, lead quality, conversion rates, appointment bookings, revenue, search placement, clinical outcomes, or treatment results.

Limitation Of Liability

To the maximum extent permitted by law, Estetix will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, revenue, business opportunity, or clinical outcome, even if advised of the possibility of such damages.

To the maximum extent permitted by law, Estetix aggregate liability for claims relating to the services will not exceed the amounts paid to Estetix for the services giving rise to the claim during the three months before the event giving rise to liability, or one hundred U.S. dollars if no amounts were paid.

Termination

Estetix may suspend or terminate access if you breach these Terms, create risk, fail to pay, misuse the platform, violate law, or if continued access would be commercially, legally, or operationally unreasonable. You may stop using the services at any time, subject to any active subscription or written agreement.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory local law provides otherwise.
